Dave Furgason, Co-Managing Director
Dave Furgason's practice consists primarily of commercial and employment litigation. Throughout his legal career, he has represented a variety of businesses and individual clients in business transactions as well as litigation. He is well versed in specific statutory matters, including employment discrimination laws, environmental laws, the Railway Labor Act, and the Federal Railroad Safety Act, along with other commercial and employment matters. He has also represented clients in cases as well as trademark and trade dress disputes.
Dave has successfully tried cases on behalf of employers in State and Federal courts, before administrative bodies, and in arbitration hearings. In addition, he has resolved many employment disputes without going to trial.
Given the cost, stress, and general disruption to parties that can result from litigation, resolving a dispute without the necessity of a trial is often more satisfying to his clients than a victory in court.
Because of Dave's experience, clients call him for general advice, as well as advice on what actions to take to avoid litigation.
Dave's training and experience also enable him to act as a mediator or arbitrator for others who desire or are required to resolve their differences by means of some form of alternative dispute resolution. His background in commercial and employment litigation serves him well in this aspect of his practice.

Litigated on behalf of a debtor-in-possession, a $300 million Superfund Claim in Bankruptcy Court
Represented a railroad in negotiations with the United States Corps of Engineers, resulting in relocation of one of the railroads lines of track and additional cash compensation
Represented a tier one company in litigation brought by the Department of Justice asserting violations of the federal price freeze laws
Represented a railroad in litigation involving its common carrier status, territorial rights and rights to compensation
