Public Lands
Large portions of the western states are comprised of public lands controlled by the United States government through the
Department of the Interior, Bureau of Land Management, National Forest Service, National Park Service and other agencies. Also,
in some western states, large portions of the land area are controlled by state governments. Dufford & Brown lawyers have over
thirty years of experience with these administrative agencies and with the administrative and litigation processes involved in
helping clients with rights and business interests in real estate, natural resource development (oil, gas, mining, timber), ranching
or agri-business, recreationalists or similar activities, to obtain necessary permits (grazing, mining, mineral processing, water,
special use and events), to obtain access to and through public lands, and with other multiple-use issues arising out of the use of
public lands including Environmental Impact Statements, NEPA compliance, FLPMA compliance, the Endangered Species Act and other state
and federal land use statutes.
Specific Public Lands Experience
- Represented beer manufacturer to confirm right to access and maintain reservoir established under the authority of a
right-of-way established pursuant to § 9 of the Mining Act of 1866 as amended.
- Assisted motorcycle club to obtain Special Use Permit to hold enduro event in National Forest.
- Assisted inholders and property owners adjoining public lands with access issues and land swaps.
- Represented the town of Yellow Pine, Idaho, against U.S. Forest Service to keep only road access to town open year-round.
- On behalf of concessionaire sought to force the U.S. Forest Service to apply insurance proceeds received as the result of the
destruction of the Crest House atop Mount Evans, Colorado to be used for its reconstruction.
- On behalf of Missouri concessionaire appealed decision by National Park Service to terminate concession contract.
